Heard learned counsel for the appellant, learned A.G.A. for the State and perused the record.

Instant criminal appeal has been preferred against the judgment and order dated 09.01.2026 passed by learned Special Judge S.C./S.T. (P.A.) Act, Ambedkar Nagar in S.T. No.45 of 2018, arising out of Case Crime No.231 of 2015, under Sections 147, 323, 325, 504, 506 IPC & Section 3(1)X S.C/S.T. Act, Police Station Bhiti, District Ambedkar Nagar, whereby accused persons have been acquitted of charge under Sections 147, 323/149, 325/149, 504, 506 IPC and Section 3(1)X S.C./S.T. Act.

Learned counsel for the appellant submitted that there are four injured persons, including the informant Janki Prasad, Surjeet, Anil Kumar and Shailendra Kumar. Janki Prasad suffered fracture in his right forearm, which is evident from his X-ray report and duly proved by Dr. P.N. Yadav. As the X-ray was done after 23 days of the evidence, it was quite possible that a callus had formed and was detected in the X-ray plate.

He next submitted that the incident occurred for the reason that Janki Prasad had stood for Gram Pradhan in the Panchayat election and the accused persons were adamant to get bogus voting done and when he raised objection to this, they assaulted, abused and insulted him with caste-indicative words. The learned trial court acquitted the accused persons, ignoring the evidence produced by the prosecution, which is

sufficient for the conviction of the accused persons. The injury reports of the injured witnesses were proved by the concerned doctors during the trial. The learned court below recorded acquittal of the accused persons after misappropriation of evidence on record. The delay of 20 days in lodging the FIR is duly explained by the evidence of PW-1, the informant.
