The instant criminal appeal has been filed by the complainant in Complainant Case No. 17 of 2022 filed in the court of learned Additional District and Session Judge/ Special Judge SC/ST Act, Ayodhya whereby the complaint has been dismissed under Section 203 Cr.P.C. for want of prosecution in absence of the complainant.

Heard learned counsel for the appellant, learned A.G.A. for the State and perused the record.

Learned counsel for the appellant submits that the trial court has dismissed the compliant on the ground that the complainant is not being appeared for the last several dates and he has failed to adduced the evidence under Section 200 Cr.P.C.

He next submitted that under Section 203 Cr.P.C. a complaint can only be dismissed when after considering the evidence under Sections 200 and 202 Cr.P.C., the Magistrate is of opinion that there is no sufficient ground for proceedings and in every such case he shall briefly record his reason for so doing. In the present case the complaint has been dismissed in default for want of prosecution.

The matter requires consideration.
