Heard learned counsel for the appellant, learned AGA for the State respondent and perused the record.

Instant criminal appeal, under section 374(2) of the Criminal Procedure Code / 415(2) of the BNSS, has been preferred against the judgment and order dated 26/11/2025 passed by the learned Special Judge, P.C. Act, Court Number 2 / Additional District and Session Judge, Lucknow, in Session Trial Number 499 of 2023, State of U.P. versus Gaurav Gupta, whereby, the court convicted the appellant and sentenced him for offenses under section 376 IPC, to 10 years rigorous imprisonment and fine of rupees 40,000; in default of payment of fine, a further imprisonment of three months. He was also sentenced under section 506 IPC, to one year rigorous imprisonment and fine of Rs5000; in default of payment of fine, further imprisonment of one month. Further he was sentenced under section 323 IPC, to six months rigorous imprisonment, and fine of Rs.5000; in default of payment of fine, further imprisonment of one month. All the sentences have been ordered to run concurrently.
