notified for acquisition. A survey/physical verification was done after the notification under section 4 and notification under section 6 was also issued and it was found that some other persons were in possession of Gata No. 386, but, other persons including the petitioner did not raise any objection to the title of the land and since no objections were raised, the land was duly acquired and an award under section 11 of the Land Acquisition Act, 1984, was declared for Village-Salahpur Rajaur, Tehsil-Tanda, DistrictAmbedkar Nagar on 26-06-2013. The petitioner did not file any objections at any stage i.e. at the stage of Section 5 A or at the stage of section 9. Under section 29 of the Land Acquisition Act, 1984, the award shall be the conclusive evidence with regard to determination of correctness of the apportionment. The respondents had paid compensation for the land of Gata No. 386 as per the award dated 26-06-2013 to respondent no. 4 and the other co-tenure holders. After 11 years of the notification for land acquisition, Basant Ram filed a case under section 144/67 of the of the U.P. Revenue Code,2006 concealing the fact of acquisition of land of Gata No. 386, only in order to stop the payment of compensation to the recorded tenure holders. The N.T.P.C.had already taken possession and was mentioned in the revenue records as owner of land of Gata No. 386. When such facts were brought to the notice of the S.D.M., Tanda, district-Ambedkar Nagar, he dismissed the case under section 144/67 of the U.P. Revenue Code by an order dated 27-09-2022, a copy of which has been filed as Annexure No. 6 to the Counter Affidavit/objections. When the writ petition was filed, no notice was issued to the private-respondents as this court prima-facie, did not find any merit in the claim of the petitioner, Basant Ram on being informed that the land had already been acquired for N.T.P.C. and the petitioner had appeared in Writ C No. 29762 of 2021 filed by the opposite party no. 4, Rajpati, the recorded tenure holder saying that he was an interested person as her house stood at Gata No. 386. The writ petition was dismissed as withdrawn on 15-12-2023 with liberty to the parties to approach the Land Acquisition Tribunal, Ambedkar. Thereafter, Basant Ram had filed another Writ Petition under Article 227 of the Constitution of India bearing no. 2179 of 2024 against the order passed by the Land Acquisition Tribunal on 1904-2024 in favour of the private respondents/recorded tenure holders. Such writ petition was pending before the court.
