Learned counsel for the applicant has submitted that the applicant is entitled for the benefit as it has been given to Deependra Prakash Tiwari, as directed by the writ Court. The respondent has passed an order in favour of the applicant in the light of the judgment passed in the case of "Deependra Prakash Tiwari" and granted the benefits i.e. treating his service as regular service since the year 1986 for the purposes of grant of pension and other consequential benefits i.e. seniority, ACP etc. but the applicant has been given the lower grade pay of Rs. 4200/- whereas Deependra Prakash Tiwari, Pratap Narain and twenty four other similarly situated persons are getting Grade Pay as Rs. 4800/-, hence the judgment and order passed by the writ Court has not been complied with in letter and spirit.
