Applicant Gagan Singh Thapa, in jail since 05.02.2026 in Case Crime No. 36 of 2026 under Sections 69 and 352 BNS, P.S. Vijaynagar, District Ghaziabad, released on bail. Counsel for the applicant contended that the prosecutrix, an adult widow and mother of three children, had herself stated in the FIR and in her statements under Sections 180 and 183 BNSS that she was in a live-in relationship with the applicant since November 2023 and that the sexual relations were consensual, hence no offence under Section 69 BNS was made out; the learned Additional Government Advocate opposed bail on the ground that the offence was cognizable and grave. The Court, after hearing counsel and perusing the record, took a holistic view of the material facts and circumstances, the nature of the evidence, the absence of any concrete contradictory material and the absence of any likelihood of tampering, and held the applicant fit to be released on bail. सूची पुनरीिक्षत वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र, आवेदक गगन िसह थापा की ओर से मु०अ०सं०-36/2026 धारा-69,352 बी.एऩ.एस. थाना- िवजयनगर, िजला गािजयाबाद में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढंग से झूठा फंसाया गया है, उसने किथत अपराध कािरत नहीं िकया है। प्रथम सूचना िरपोटर् िवलम्ब से दजर् करायी गयी िवलम्ब का कोई स्पष्टीकरण नहीं िदया गया। उक्त घटना का कोई स्वतंत्र साक्षी नही है। आवेदक के िवद्वान अिधवक्ता का कथन है िक पीिड़ता द्वारा एफआईआर में और साथ ही धारा 180 और 183 बी.एन.एस.एस. के बयानों में पीिड़ता ने आवेदक के िखलाफ आरोप लगाया है िक वह उसके साथ शादी के बहाने कई बार यौन संबंध स्थािपत िकए, उसके बाद भी उसने उससे शादी नहीं की और बराबर शादी से इनकार करता रहा। उन्होंने आगे यह भी कथन िकया िक पीिड़ता एक िवधवा, तीन बच्चों की मां है जोिक पूणर्तः एक वयस्क मिहला है। पीिडता द्वारा अंतगर्त धारा 183 बी.एन.एस.एस. के बयान में यह स्पष्ट कथन िकया गया है िक वह आवेदक के साथ िलव इन िरलेशनिशप में रह रही थी। पीिड़ता के उक्त बयानों के अवलोकन से ऐसा प्रतीत होता है िक पीिड़ता, आवेदक के साथ संबंध में थी और उनके बीच जो भी यौन संबंध िवकिसत हुए थे, वे सहमित से थे, इस प्रकार, बी.एन.एस. की धारा 69 का आरोप आवेदक पर नहीं बनता है। क्योंिक वे नवम्बर 2023 से एक लंबी अविध से संबंध में थे और इस संबंध में पीिड़ता द्वारा कोई पूवर् िशकायत नहीं की गई है, इसिलए, ऐसा प्रतीत होता है िक आवेदक को झूठे और तुच्छ आरोपों और दुभार्वनापूणर् इरादे से मामले में फंसाया गया है। पुनः उनका कथन है िक आवेदक की ओर से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से अदालत के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतों को स्वीकार करने

के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेदक िनदोर्ष है तथा वह इस प्रकरण में िद० 05.02.2026 से कारागार में िनरुद्ध है इसिलए आवेदक को जमानत पर छोड़ िदया जाय।

िवद्वान अपर शासकीय अिधवक्ता ने आवेदक के िवद्वान अिधवक्ता के तकोर् का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक आवेदक द्वारा कािरत अपराध संज्ञेय एवं गंम्भीर प्रकृित का है , इसिलए आवेदक को जमानत पर न छोड़ा जाये।

आवेदक के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य प्रश्नगत प्रकरण में पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद , सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की सन्तुिष्ट पर व्यिक्तगत बंध - पत्र एवं अिधक धनरािश के दो स्थानीय प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

आवेदक अिभयोजन सािक्षयों व पीिड़ता / िशकायतकतार् को डरायेगा / धमकायेगा नहीं।

आवेदक न्यायालय के आदेशों का पालन करेगा , वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईमानदारी से सहयोग करेगा।

आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगा और िकसी भी अपरािधक गितिविध में िलप्त नहीं होगा न कोई अपरािधक कृत्य करेगा।

आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा, िजसके कारण उन्हें न्यायालय में तथ्यों को उजागर करने से िवरत रहना पडे़।

उपरोक्त शतोर्ं में से िकसी के उल्लंघन के मामले में , परीक्षण न्यायालय आवेदक की जमानत िनयमानुसार रद्द करने को स्वतंत्र है।
