सूची पुनरीि�त वत�मान दाि�डक �कीण� जमानत �ाथ�ना प�, आवेदक क�लू िसह की ओर से मु.अ.सं० 539/2025 अ�तग�त धारा 74/ 64(1)/ 351(3) बी.ए�.एस. थाना रसूलाबाद, िजला कानपुर देहात म� जमानत पर मु� करने हेतु ��तुत िकया गया है।

आवेदक के िव�ान अिधव�ा एवं िव�ान अपर शासकीय अिधव�ा को सुना तथा प�ावली का पिरशीलन िकया।

�ा�त अनुदेश के अनुसार िवप�ी सं० 2 को नोिटस िन�पािदत/तामील कराया जा चुका है पर�तु उनकी ओर से कोई उपि�थत नह� है।

आवेदक के िव�ान अिधव�ा ने तक� ��तुत िकया िक आवेदक को इस �करण म� गलत एवं फज� ढंग से झूठा फंसाया गया है, उसने किथत अपराध कािरत नह� िकया है। किथत पीि�ता �ारा अपने धारा 180 भारतीय नागिरक सुर�ा संिहता के बयान म� आवेदक पर िसफ� छेडछा� का आरोप आ�ेिपत नह� िकया िकतु �राशय के तहत अपने धारा 183 भारतीय नागिरक सुर�ा संिहता के बयान म� आवेदक के िव�� िविश� आरोप का अिभकथन िकया गया। किथत पीि�ता के धारा 180 व 183 भारतीय नागिरक सुर�ा संिहता के बयान म� पर�पर िवरोधाभाष है। इसिलए आवेदक जमानत पर मु� िकये जाने यो�य है। पुनः उनका कथन है िक आवेदक की ओर से यह आ�ासन िदया गया है िक वह कानून की �ि�या म� सहयोग करने के िलए तैयार है और जब भी आव�यकता होगी वह ईमानदारी से अदालत के सम� खुद को उपल�ध कराएगा और उन सभी शत� को �वीकार करने के िलए भी तैयार है जो �यायालय उस पर अिधरोिपत करेगी। आवेदक िनद�ष है तथा वह इस �करण म� िद० 13.01.2026 से कारागार म� िन�� है इसिलए आवेदक को जमानत पर छो� िदया जाय।

िव�ान अपर शासकीय अिधव�ा ने आवेदक के िव�ान अिधव�ा के तक� का �बल िवरोध करते �ए तक� ��तुत िकया िक आवेदक �ारा कािरत अपराध सं�ेय एवं गं�भीर �कृित का है , इसिलए आवेदक को जमानत पर न छो�ा जाये।

आवेदक के िव�ान अिधव�ा के तक� के पिर�े�य ��नगत �करण म� प�ावली पर उपल�ध सारवान त�य� एवं पिरि�थितय� का सम� �प से अवलोकन करने के बाद , सबूत� की �कृित और िकसी भी ठोस िवरोधा�मक साम�ी की अनुपि�थित एवं उपल�ध साम�ी से छे�छा� की संभावना न होने के त�य को देखते �ए मेरी राय म� आवेदक को जमानत पर मु� करने का उपयु� आधार है।

अतः वाद के गुण दोष पर िबना कोई िट�पणी िकए �ए आवेदक को उपरो� विणत अपराध म� संबंिधत �यायालय की स�तुि� पर �ि�गत बंध - प� एवं अिधक धनरािश के दो �थानीय �ितभू ��तुत करने पर िन�निलिखत शत� के साथ जमानत पर छो� िदया जाय।

आवेदक िववेचना या परी�ण के दौरान अिभयोजन सा�य� के साथ छे�छा� नह� करेगा।

आवेदक अिभयोजन साि�य� व पीि�ता / िशकायतकता� को डरायेगा / धमकायेगा नह�।

आवेदक �यायालय के आदेश� का पालन करेगा , वह परी�ण के दौरान िबना कोई अनाव�यक �थगन िलए िनयत ितिथ पर �यायालय म� उपि�थत होगा तथा परी�ण म� ईमानदारी से सहयोग करेगा।

आवेदक जमानत पर िरहा होने के बाद जमानत की �वतं�ता का ��पयोग नही करेगा और िकसी भी अपरािधक गितिविध म� िल�त नह� होगा न कोई अपरािधक कृ�य करेगा।

आवेदक ��य� या अ��य� �प से मामले के त�य� से पिरिचत िकसी भी �ि� या पुिलस अिधकािरय� को कोई �लोभन या धमकी नह� देगा न ही उनसे कोई वायदा करेगा, िजसके कारण उ�ह� �यायालय म� त�य� को उजागर करने से िवरत रहना पडे़।

उपरो� शत� म� से िकसी के उ�लंघन के मामले म� , परी�ण �यायालय आवेदक की जमानत िनयमानुसार र� करने को �वतं� है।
