Heard Ms. Babita Upadhyay, Advocate appearing for applicant as instructed by the High Court Legal Services Committee and Learned AGA for the State and perused the record.

The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime no.542 of 2023, under Sections 3(1) of U.P. Gangster and Anti Social Activities (Prevention) At 1986, Police Station Shivpur, District Varanasi.

Ms. Babita Upadhyay contends that the applicant has been implicated in the present case on the basis of three base cases mentioned in the gang chart.

This Court on the previous occasion had asked Learned AGA to obtain instructions with respect to the cases shown in the gang chart as well as criminal antecedents of the applicant.

Today, Learned AGA states that he has received instructions. He states that the applicant is on bail in the base cases shown in the gang chart, however, the applicant has a criminal history of two other cases, the status of which could not be verified by the Investigating Officer.

I have considered the submissions made by Learned counsels for the parties.

The applicant is in jail since 11.12.2023. He is stated to be on bail in

the base cases mentioned in the gang chart. Despite time having been granted to the Learned AGA to find out regarding the present status and criminal antecedents of the applicant, the Learned AGA has not been able to provide the present status of the two additional cases shown against the applicant.

Be that as it may, taking into account the long period of detention of the applicant in the present case as well as the fact that the applicant is on bail in the base cases mentioned in the gang chart, I find it appropriate to enlarge the applicant on bail.

The bail application is allowed .

Let the accused-applicant, Pramod Tiwari @ Sintu , involved in above mentioned case crime number be released on bail, on his executing a personal bond, subject to the following conditions:

(i) The applicant will not tamper with the evidence.

¶22

(ii) The applicant will not indulge in any criminal activity.

¶23

(iii) The applicant will not pressurize/intimidate the prosecution witnesses and co-operate in the trial.

¶24

(iv) The applicant will appear regularly on each and every date fixed by the trial court, unless his personal appearance is exempted by the court concerned.

In the event of breach of any of the aforesaid conditions, the court concerned will be at liberty to proceed to cancel his bail.

It is made clear that the applicant shall be released on the basis of computer generated copy of this order, downloaded from the official website of High Court Allahabad and verified by the concerned counsel with the undertaking that the certified copy will be filed within 15 days.

It is further directed that the trial court shall send the release order to the concerned jail through Bail Order Management System (BOMS) to ensure early release of the applicant.
