Heard learned counsel for the applicant and learned A.G.A.

Supplementary affidavit filed on behalf of the applicant is taken on record.

This is first bail application filed on behalf of the applicant who is involved in Case Crime No.154 of 2023, Under Section 307 I.P.C., Police Station Makhi, District Unnao.

Learned counsel for the applicant submits that as per paragraph 2 of the supplementary affidavit, statements of P.W.-2 and P.W.-3 have been recorded before the trial court and they have turned hostile to the prosecution story, copies of statements have been annexed as Annexure No.SA-1 and SA-2 to the supplementary affidavit. From perusal of the injury report of the victim annexed as Annexure No.7 to the bail application, all injuries are simple in nature. The applicant is languishing in jail since 14.6.2023. The applicant has no criminal history. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Hence, the applicant may be granted bail.

Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant.

On due consideration to the facts that all injuries are simple in nature; P.W.-2 and P.W.-3 have turned hostile before the trial court; applicant is in judicial custody since 14.6.2023; the applicant has no criminal history, without entering into the merits of the case, this Court is of the view that it is a fit case for enlarging the applicant on bail.

Accordingly, the bail application is allowed.

Let the applicant- Rajan Pasi involved in Case Crime No.154 of 2023 (supra) be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:-

(i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court, either personally or through his counsel.

Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed.

It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial.
