Sanjay Singh vs State of U.P.

Learned counsel for the applicant submits out of the conjugation of the applicant and victim one child has born. He further submits that the husband of the victim died and that the applicant is the brother-in-law (devar) of the victim. The deponent of the bail application namely, Pitam Singh, who is the father of the applicant, had also sought instructions from the applicant and has stated that the applicant is ready to solemnise marriage with the victim, after his enlargement on bail. He further submits that due to intervention of the elderly persons of the locality as well as relatives, 11.03.2026 is the date fixed for the marriage of the applicant with the victim and in this regard marriage invitation card has also been printed. He further submits that in case, the applicant is enlarged on bail, he would solemnise marriage with the victim.

On the other hand, Sri Pavan Kumar Singh, learned counsel for the informant/victim has stated that the marriage between the victim and the applicant has been settled for 11.03.2026 and to demonstrate the same, learned counsel has drawn attention of this Court to Annexure-1 to the affidavit, which is the marriage invitation card of the victim and applicant, which affidavit has been filed today today in the Court and is taken on record. The victim is also present before this Court, who is identified by her counsel and she has verified the veracity of statements/submissions advanced by her counsel as well as by the counsel for the applicant. Learned A.G.A. has contended that the marriage date is fixed for 11.03.2026 and about one and a half months to go for the marriage, in case the applicant is enlarged bail, he may misuse the same.

In reply to the aforesaid submission advanced by learned A.G.A., learned counsel for the applicant as well as learned counsel for the informant have jointly submitted that the applicant may be enlarged on interim bail till solemnisation of their marriage, who after being enlarged on bail would solemnise marriage and thereafter would apply for registration of their marriage before the Marriage Registration Officer, which could not be disputed by learned A.G.A.

After perusing the record in the light of the submissions made at the bar and after taking an overall view of all the facts and circumstances of this case, especially the submissions that the applicant and the victim are ready to solemnise marriage and would apply for registration before the concerned Marriage Registration Officer, the nature of evidence and also the absence of any convincing material to indicate the possibility of tampering with the evidence, without expressing any opinion on merits of the case, this Court is of the view, that the applicant may be enlarged on interim bail.

Let applicant Sanjay Singh involved in Case Crime No. 229 of 2025 under Section 69 of B.N.S. of I.P.C., Police Station Mangalpur, District Kanpur Dehat, be released on interim bail for a period of six weeks from today w.e.f 02.02.2026 to 16.03.2026, on furnishing a personal bond and two local sureties each of the like amount to the satisfaction of the court concerned subject to the following conditions:-

i) The applicant shall solemnise marriage on the date fixed i.e. 11.03.2026 and would thereafter, apply for registration of marriage, before the concerned Marriage Registration Officer within the interim bail period.

ii) The applicant shall not tamper with the prosecution evidence.

iii) The applicant shall not threaten or harass the prosecution witnesses.

iv) The applicant shall appear on the date fixed by the trial court.

v) The applicant shall not commit an offence similar to the offence of which the applicant is accused, or suspected of the commission.

vi) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade such person from disclosing facts to the Court or to any police officer or tamper with the evidence.

In case of breach of any of the above condition, the trial Court shall be at liberty to cancel the bail of the applicant in accordance with law.

List on 16.03.2026 on which date, an affidavit of compliance be filed by learned counsel for the applicant to demonstrate that the marriage has been registered/solemnised before the Marriage Registration Officer.

It is also made clear that the applicant and the victim shall remain present in-person before this Court on the date fixed in the matter.
