Allahabad High Court (Court No. 65), Criminal Misc. Bail Application No. 33806 of 2025 — Abhay Kumar v. State of U.P. and 3 Others; interim order of Dr. Gautam Chowdhary, J., dated January 19, 2026. Notice had been duly served on the opposite parties per office report dated 08.01.2026, none attending on their behalf. Counsel for the applicant urged that in the victim's statement under Section 183, Bharatiya Nagarik Suraksha Sanhita, no specific allegation was levelled against the applicant; that the victim presently resides at the applicant's house and is a consenting party; and prayed for time to produce the victim in person before the Court on an advance fixed date for verification of these facts. The Additional Government Advocate contended that the victim is a minor, but raised no objection to those facts. Granting the prayer, the Court allowed time as sought and, at counsel's request, directed listing of the case on 04.02.2026 in the top-ten-cases list. आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

कायार्लय आख्या, िदनांिकत 08.01.2026 के अनुसार सूचनाकतार् को नोिटस तामील करायी जा चुकी है, िकतु उनकी ओर से कोई उपिस्थत नहीं है।

आवेदक के िवद्वान अिधवक्ता द्वारा तकर् प्रस्तुत िकया गया िक पीिड़ता द्वारा अपने धारा 183 भारतीय नागिरक सुरक्षा संिहता के बयान में आवेदक पर कोई िविशष्ट आक्षेप अिभकिथत नहीं िकया गया है। वतर्मान में पीिड़ता आवेदक के घर पर ही िनवास कर रही है तथा वह सहमत पक्षकार है। इन तथ्यों की पिरपुिष्ट हेतु वह पीिड़ता को अिग्रम िनयत ितिथ पर न्यायालय के समक्ष व्यिक्तगत रूप से उपिस्थत कराना चाहते है। इसके िलए उन्हें समय प्रदान कर िदया जाय।

िवद्वान अपर शासकीय अिधवक्ता का तकर् है िक पीिड़ता अवयस्क है, िकतु उन्हें उपयुर्क्त तथ्यों पर कोई आपित्त नहीं है।

उपयुक्तर् तथ्यों के मद्देनजर आवेदक के िवद्वान अिधवक्ता को यथाप्रािथत समय प्रदान िकया जाता है।
