Learned counsel for the applicant submitted that statement of the injured has not yet been recorded whereas first information report was registered on 23.11.2025.

Learned A.G.A. informs that investigation is going on but statement of the injured has not been recorded because in C.D. No.5 the I.O. has mentioned that the injured is not in a position to speak that is why the statement of the injured has not been recorded. In this case, as per submission of learned A.G.A, injured sustained grievous injuries, therefore, he is unable to speak.

Considering the facts and circumstances of the case, the Investigating Officer of this case is directed to record the statement of the injured by way of legal means and also submit status of investigation of this case by means of affidavit.

List on 23.02.2026 at 2.00 P.M ..

On the date fixed the Investigating Officer of this case shall be present in person before this Court.
