This matter was heard on 09.04.2026. On that date, learned AGA was directed to produce the FSL report regarding the country-made pistol recovered on pointing out of the applicant as well as the bullet recovered from the body of the deceased.

Learned AGA has informed that in pursuance of order dated 09.04.2026, he received instructions on 05.05.2026 from the Incharge Inspector, Police StationCantt, Commissionerate, Prayagraj wherein it is mentioned that the bullet found in the body of the deceased and pistol recovered from the applicant were sent to FSL examination Jhansi on 09.02.2026 to obtain the FSL report, reminder was again sent on 05.05.2026 by the ACP, Civil Lines, Commissionerate, Prayagraj to the Director, FSL, Phaphamau, Prayagraj.

From perusal of the instructions as well as reminder, it is clear that the reminder dated 05.05.2026 was sent by the ACP, Civil Lines, Commissionerate to Director FSL, Phaphamau, though the bullet recovered from the body of the deceased as well as pistol recovered on pointing out of the applicant has been sent to FSL, Jhansi. The above fact shows complete non-application of mind on the part of ACP, Civil Lines, Commissionerate, Prayagraj, as no reminder has been sent to FSL, Jhansi.

Therefore, ACP, Civil Lines, Commissionerate, Prayagraj is directed to appear before this court personally on the next date of listing and explain this negligence.

Put up as fresh on 13.05.2026.

Registrar (Compliance) is directed to send a copy of this order to the ACP, Civil Lines, Commissionerate, Prayagraj, for necessary compliance.
