Piyush Tripathi, learned Advocate filed his power on behalf of informant, today in the Court, which is taken on record.

Sri Anil Kumar Ojha, learned counsel for applicant, Sri Piyush Tripathi, learned counsel for informant and Sri Rajeev Dhar Dwivedi, learned AGA for the State are present.

Learned counsel for applicant submits, however, applicant is husband of the deceased but deceased was mentally ill and she was under continuous treatment, therefore, she committed suicide and specific averment in this regard has been made by the applicant in para-13 of the affidavit but he fairly conceded, he could not file any medical document of the deceased.

Considering the submission made by learned counsel for applicant, learned AGA as well as learned counsel for informant are directed to file detailed counter affidavit within two weeks disclosing the fact that whether deceased was mentally ill and whether she was under medical treatment or not. Rejoinder affidavit, if any, may be filed by the applicant within two weeks thereafter.
