Heard Sri Ankit Yadav, the learned counsel for the petitioner, Sri Pradeep Kumar Dwivedi, the learned counsel for the opposite parties.

This is an application under Section 11 (6) of Arbitration and Conciliation Act seeking appointment of an Arbitrator for adjudication of the disputes between the parties regarding payment to be made in furtherance of an agreement dated 11.08.2018.

The opposite parties filed counter affidavit stating that the entire payment has already been made to the petitioner and the petitioner has made an endorsement on the bill that it is acceptable to him and no payment is due to be made to him.

In reply to the aforesaid argument the learned counsel for the petitioner has submitted that the aforesaid endorsement has not been made by the petitioner out of his freewill and he was made to sign under coercion.

The aforesaid submissions made by the learned counsel for the opposite parties and the learned counsel for the petitioner make out disputes regarding final payment made to the petitioner which needs to be adjudicated by the Arbitrator.

Accordingly, the Court proposes the name of Hon'ble Mr. Justice S.V.S. Rathore (Retd.) R/o 17, Vikramaditya Marg, Lucknow, Mobile No. 9415183875, 7400463875 to act as an Arbitrator to adjudicate upon the
