Heard learned counsel for the applicant, learned AGA for the State and perused the record.

The instant application has been filed for a direction to direct the learned trial court i.e. the learned Chief Judicial Magistrate, Baharaich to decide/conclude the trial of the Case No. 10146 of 2017 "State Versus Mubin Ahmad & Others" arising out of Case Crime No. 2406/2016, Under section- 419, 420, 504 & 506 of the Indian Penal Code, 1860 pertaining to Police Station- Kaisarganj, District- Baharaich, pending before him since 03.10.2017, expeditiously or within a stipulated time to be prescribed by this Hon'ble Court, in the interest of justice.

Learned counsel for the applicant quoting the aforesaid prayer submits that the matter is still pending consideration since 2017 and the applicant is suffering due to delay in conclusion of the trial proceedings. He submits that the interest of justice would be subserved if this Hon'ble Court is pleased enough to direct the trial Court to conclude the trial proceedings of Case No. 10146 of 2017 arising out of Case Crime No. 2406/2016, Under section419, 420, 504 & 506 of IPC Police Station- Kaisarganj, District- Baharaich, within a stipulated period of time as may be fixed by this Court.

The counsel appearing for the State has no objection to the contention aforesaid.

Trial Court is hereby directed to conclude the proceeding of Case No. 10146 of 2017 arising out of Case Crime No. 2406/2016, Under section- 419, 420, 504 & 506 of IPC Police Station- Kaisarganj, District- Baharaich, expeditiously, if there is no legal impediment, while considering the guidelines and circulars issued in this regard.
