Heard Sri Kamlesh Kumar Yadav, learned counsel for the applicant and learned AGA for the State.

The applicant has approached this Court mainly for the following prayer:

"Issue a suitable order or direction of commanding the Learned Add. Court No. 12 Lucknow to decide the U/S. 138 N.I. ACT, 1881, bearing, Case No.-2076/2021, Dharmendra Kumar Vs Abhishek Singh, expeditiously within such period as may be stipulated by this Hon'ble Court, in the interest of justice."

Learned counsel for the applicant submits that under Section 143(3) of the N.I. Act, it is provided that every trial under this Section shall be conducted as expeditiously as possible and endeavour shall be made to conclude the trial within six months from the date of filing of the complaint. He has submitted that since long time, the case is pending without substantial progress.

Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant and submits that merely keeping pending the same by the trial court does not suffice any purpose of the litigation.

In view of the aforesaid facts, the court concerned is directed to adhere to the provisions of Section 143(3) of the N.I. Act and shall act accordingly and decide the aforesaid case expeditiously in accordance with law within a period of six months from the date a certified copy of this order is placed before the court concerned.
