Heard learned counsel for the applicant and Sri Jas Karan Lal Maurya, learned AGA for the State.

The applicant has approached this Court mainly for the following prayer:

".. to direct the Court of the Learned Additional Court, N.I. Act - 6 Lucknow to decide the Complaint Case No. 78328 of 2023; Ashok Dubey Vs. Uday Pratap Singh & another Under Section 138 of Negotiable Instruments Act, 1881 Police Station Madeyganj District Lucknow, expeditiously as this Hon'ble Court may deemed fit which is pending before the Court of Learned Additional Court N.I. Act-6, Lucknow since 17.07.2023 (Contained as Annexure No. 1), in the interest of Justice."

Learned counsel for the applicant submits that under Section 143(3) of the N.I. Act, it is provided that every trial under this Section shall be conducted as expeditiously as possible and endeavour shall be made to conclude the trial within six months from the date of filing of the complaint. He has submitted that since long time, the case is pending without substantial progress.

Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant and submits that merely keeping pending the same by the trial court does not suffice any purpose of the litigation.

In view of the aforesaid facts, the court concerned is directed to adhere to the provisions of Section 143(3) of the N.I. Act and shall act accordingly and decide the aforesaid case expeditiously in accordance with law within a period of six months from the date a certified copy of this order is placed before the court concerned.
