Heard learned counsel for the petitioners as also the learned A.G.A. for the State, and perused the record.

The petitioners have filed this application with the following main prayer:

".. this Hon'ble Court may kindly be pleased to exercise the power U/S- 483 Cr.P.C. (now Section 529 B.N.S.S.) and direct the Ld. Additional Principal Judge Court No. 3 Family Court Lucknow to decide the interim maintenance application filed in Case no. 1494/2024 U/s 125 Cr.P.C./144 B.N.S.S. pending since 01.07.2024 as possible or time stipulated by this Hon'ble Court in the interest of justice."

Learned counsel for the applicant submits that the case application is pending since 01.07.2024 without substantial progress, hence, a positive direction be given to the trial court to decide the aforesaid case within a stipulated period.

Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant and submits that a positive direction be given to the trial court to decide the case of the applicant, as merely keeping pending the same by the trial court does not suffice any purpose of the litigation.

In view of the submissions made by the learned counsel for the parties, as the matter is of 2024, the trial court is directed to decide the aforesaid case expeditiously, without granting any unnecessary adjournment to either of the parties from the date of filing of the certified copy of this order, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case.
