Home Deptt., Lko. and another), decided February 26, 2026. FIR No.405 of 2021, Police Station Inayat Nagar, District Ayodhya, lodged by the wife of the applicant's brother, levelled Sections 498A, 323, 504, 506, 376, 511, 354-B, 406 IPC and Section 3/4 of D.P. Act against the entire matrimonial family; on the subsequent charge-sheet, the applicant alone was charge-sheeted under Section 376 IPC (with other sections) while the other matrimonial family was not charge-sheeted under Section 376. Counsel stated the parties had compromised their disputes (essentially marital discord) and that the compromise was duly verified by the court below vide order dated 20.02.2026, per the report of the Additional Chief Judicial Magistrate, Ayodhya. 1 . Heard learned Counsel for the parties.

2 . The FIR in question was lodged by the informant, who is the wife of the brother of the applicant. In the FIR in question, the allegations of Sections 498A, 323, 504, 506, 376, 511, 354-B, 406 IPC and Section 3/4 of D.P. Act were also levelled against the entire matrimonial family. Subsequently, the charge-sheet was filed in which the applicant was charge-sheet under Section 376 of IPC along with other sections whereas the other matrimonial family was not charge-sheet under Section 376 of IPC.

It is stated by the Counsel for the parties that the parties have compromise their disputes as it was essentially on account of marital discord and no material existed for justifying the allegations of Section 376 of IPC. It is also informed that the compromise has been duly verified by the court below vide order dated 20.02.2026, which is evident from the report submitted by the Additional Chief Judicial Magistrate, Ayodhya.

Considering the nature of the allegations levelled in the FIR against the entire matrimonial family and the fact that the parties have entered into a compromise, which has been verified and in view of the law as explained in the case of Madhukar and others vs State of Maharashtra and another: 2025 INSC 819 , the entire proceedings of Criminal Misc.
