Heard Shri Dharam Trivedi, Advocate holding brief of Shri Surendra Kumar Mishra, learned counsel for the applicant, learned A.G.A for the State as well as Shri Ashutosh Kumar, Srivastava, learned counsel for opposite party no. 2 and perused the record.

The present application under Section 482 Cr.P.C/528 B.N.S.S has been preferred with the following main prayer:-

" ---it is most respectfully prayed that this Hon'ble Court may kindly be pleased to stay the effect and implementation of order dated 18.03.2025, passed by Criminal Learned Sessions Judge, Lakhimpur Kheri in Criminal Revision No. 07/2025 (Harishchandra Verma @ others versus State of U.P and another) as well as the order dated 06.01.2023, passed by Learned Additional Civil Judge (J.D)/Judicial Magistrate Court No. 7, Kheri in Complaint Case No. 264 of 2022, till the pendency of this petition "

Learned counsel for the applicant has submitted that the applicants have challenged the summoning order as well as the entire proceedings arising out of Case No. 264 of 2022. In the meantime, the charges have been framed against the applicants. At this stage, learned counsel for applicants has submitted that he does not want to press the present application and the same

may be dismissed as not pressed, but liberty may be given to the applicants to file a fresh application against the rejection of the discharge application.

As prayed, the present application is dismissed as not pressed with the aforesaid liberty.
