Heard Sri Rakesh Kumar, the learned counsel for the petitioners, Sri G.D. Bhatt, the learned AGA-I for the State of U.P. and Sri Jayant Chatruvedi, the learned counsel for the complainant.

By means of the instant petition filed under Section 528 BNSS/ 482 Cr.P.C., the petitioners have challenged the validity of an order passed by the trial court issuing non bailable warrants because of non appearance of the petitioners.

The record reveals that the NBW were issued against several co-accused persons who have appeared before the trial court and sought cancellation of the NBW, have been allowed.

In these circumstances, the petition is disposed off by directing the applicants also to appear before the trial court and file application seeking recall of non bailable warrants/ their release on bail. In case such an application is filed, the trial court shall pass appropriate orders thereon in accordance with law keeping in the mandate laid down by the Hon'ble Supreme
