अपील प्रस्तुत करने हेतु अनुमित प्राथर्ना-पत्र पर आदेश

राज्य सरकार के िवद्वान अपर शासकीय अिधवक्ता श्री बदरुल हसन को सुना।

िवद्वान िवशेष न्यायाधीश, पॉक्सो, बलरामपुर द्वारा वाद संख्या 74/2018 में पािरत दोषमुिक्त के िनणर्य तथा आदेश िदनांक 15.09.2025 के िवरुद्ध राज्य सरकार द्वारा यह अपील प्रस्तुत करने िकए जाने के प्राथर्ना-पत्र एवं 114 िदन के िवलंब क्षमा िकए जाने के प्राथर्ना-पत्र के साथ प्रस्तुत िकया है।

आलोच्य िनणर्य से यह प्रतीत होता है िक प्रथम सूचना िरपोटर् का कथन था िक िदनांक 31.07.2018 को िदन में लगभग 2 बजे िशकायतकतार् की 19 वषीर्य पुत्री अपने खेत में घास उठाने गई थी तभी पीछे से अिभयुक्त राजू यादव (िवपक्षी संख्या 1) आकर छेड़छाड़ करने लगा। शोर-शराबा होने पर गांव के तमाम लोग दौड़े एवं अिभयुक्त भाग गया।

िवचारण न्यायालय के समक्ष पीिड़ता, उसकी मां िशकायतकतीर्, िचिकत्सक एवं तीन पुिलसकिमयों को परीिक्षत कराया गया। अिभयुक्त ने दंड प्रिक्रया संिहता की धारा 313 के अंतगर्त बयान में अपने िवरुद्ध आरोपों से इंकार करते हुए कहा िक उसने पीिड़ता के साथ न ही कोई छेड़छाड़ िकया है और न ही गाली-गलौज िकया है एवं न ही चोट पहुंचाया है। उसे रंिजश वश फंसाया गया है।

समस्त साक्ष्यों की समीक्षा करते हुए िवचारण न्यायालय ने यह पाया िक प्रथम सूचना िरपोटर् में पीिड़ता की आयु 19 वषर् िलखी है, यद्यिप, पीिड़ता ने मुख्य परीक्षा में अपनी आयु घटना के समय 17 वषर् बताई, आयु के साक्ष्य के संबंध में कक्षा 5 का स्थानांतरण प्रमाण-पत्र एवं छात्र रिजस्टर प्रस्तुत िकया गया िजसमें पीिड़ता की आयु 01.07.2001 अंिकत है। िवद्यालय के प्रधानाध्यापक ने यह कहा िक उसने पीिड़ता का प्रवेश िवद्यालय में नहीं कराया था। िवद्यालय के अिभलेखों में

पीिड़ता की जन्मितिथ अंिकत करने का स्रोत क्या था यह प्रधानाध्यापक नहीं बता पाए। िवचारण न्यायालय ने पाया िक धारा 94 िकशोर न्याय ( बालकों की देखरेख एवं संरक्षण) अिधिनयम 2015 के प्रावधान के अनुसार कक्षा 5 का स्थानांतरण प्रमाण-पत्र/ अंकसूची साक्ष्य में ग्रहण िकए जाने योग्य नहीं है।

प्रथम सूचना िरपोटर् में िशकायतकतीर् ने घटना के समय पीिड़ता की आयु 19 वषर् बताई तथा िवचारण न्यायालय ने यह पाया िक घटना के समय पीिड़ता अवयस्क नहीं थी।

पीिड़ता ने अपनी प्रित-परीक्षा में यह कहा िक घटना के समय मौके पर उसके चाचा मौजूद थे तथा उसके बाद उसने कहा िक चाचा दूर थे। उसने कहा िक उसके चाचा और भाई दोनों घटना के समय उपिस्थत नहीं थे। पीिड़ता ने यह भी कहा िक जब मिहला पुिलस ने उसे चेक िकया था तो उसके शरीर पर कोई चोट नहीं थी। िशकायतकतीर् ने अपनी मुख्य परीक्षा में प्रथम सूचना िरपोटर् के कथनों को दोहराया, िकतु प्रित-परीक्षा में उसने कहा िक वह पढ़ी-िलखी नहीं है, थाने पर दी गई िशकायत उसके लड़के ने िलखी थी तथा उसने अपने लड़के को नहीं बताया था िक िशकायत में क्या िलखना है। िशकायतकतीर् ने कहा िक पीिड़ता को घटना के समय कोई चोट नहीं लगी थी।

िचिकत्सक ने अपने बयान में कहा िक पीिड़ता के बाएं पैर में 1.0 x0.3 सेमी. की खरोच थी जो िगरने-पड़ने से आ सकती है तथा स्वयं भी कािरत की जा सकती है।

िवचारण न्यायालय ने पीिड़ता की मुख्य परीक्षा एवं प्रित परीक्षा का िवस्तृत िवश्लेष करते हुए यह पाया िक पीिड़ता ने पुिलस के समक्ष कथन तथा दंड प्रिक्रया संिहता की धारा 164 के अंतगर्त अपने कथन में अिभयुक्त से छुड़ाने की प्रिक्रया में शरीर पर चोट आना कहा है, जबिक मुख्य परीक्षा में ऐसा कोई कथन नहीं िकया है। िशकायतकतीर् ने कहा है िक घटना में पीिड़ता को कोई चोट नहीं लगी थी। िशकायतकतीर् के अनुसार घटना के समय आसपास दो लोग मौजूद थे जो उसके िरश्तेदार हैं तथा पीिड़ता ने भी इस बात को स्वीकार िकया है लेिकन उन व्यिक्तयों का परीक्षण अिभयोजन ने न्यायालय में नहीं कराया है और न पीिड़त पक्ष ने उनके परीक्षण की आवश्यकता समझी है।

उपरोक्त तथ्यों एवं साक्ष्यों की िवस्तृत समीक्षा करते हुए िवचारण न्यायालय ने यह पाया िक अिभयोजन अपने कथानक को संदेह से परे िसद्ध नहीं कर पाया है एवं अिभयुक्त को संदेह का लाभ प्रदान करते हुए दोषमुक्त कर िदया है।

िवचारण न्यायालय के िनणर्य की समीक्षा से यह प्रतीत होता है िक िनणर्य समस्त तथ्यों एवं सम्यक िववेचना पर आधािरत है तथा इसे अनुिचत नहीं कहा जा सकता है।

ऐसी पिरिस्थित में दोषमुिक्त आदेश के िवरुद्ध अपील प्रस्तुत करने की अनुमित देने का पयार्प्त आधार नहीं है। तदनुसार, अनुमित प्राथर्ना-पत्र िनरस्त िकया जाता है।

िवलंब मषर्ण हेतु धारा-5 िमयाद अिधिनयम के अंतगर्त प्राथर्ना-पत्र पर आदेश

इस न्यायालय ने अपील प्रस्तुत करने की अनुमित देने हेतु प्राथर्ना-पत्र िनरस्त कर िदया है।
