Heard learned counsel for the applicant and learned AGA for the State. None appears for opposite party nos.2 and 3.

The present application has been filed seeking quashing of the entire proceedings of Misc. Criminal Case No.157 of 2024 under Section 125(3) Cr.P.C., Police Station Kotwali Dehat, District Sitapur along with all consequential orders passed by the Additional Principal Judge, Family Court, Court no.2, Sitapur as well as recovery warrant dated 13.9.2024 issued in the aforesaid case.

Learned counsel for the applicant submits that he does not want to press this application on merits. However, he submits that the applicant wants to file a recall application before the court below for recall of the order dated 4.6.2019, since the said order is ex-parte.

Accordingly, this application is dismissed with liberty to the applicant to move an application for recall of the order dated 4.6.2019 before the court below and the court below will take a decision on the said application of the applicant, in accordance with law, after affording opportunity of hearing to the parties.
