High Court of Judicature at Allahabad, Lucknow Bench (Subhash Vidyarthi, J.), 22.04.2026 — The State of U.P. sought leave under Section 378 to appeal against the judgment and order dated 13.06.2025 of the Special Judge (Gangsters Act)/Additional Sessions Judge, Court Room No. 3, Lakhimpur Kheri, in Sessions Trial No. 183 of 2004 (arising out of Case Crime No. 440 of 2003 under Sections 386, 364 IPC and Section 2/3, U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986), whereby opposite party nos. 2 and 4 (Ramjeet and Chitraka) were acquitted. The trial court had found, on the statements of the two prosecution witnesses (PW-1, the complainant; PW-2), that the prosecution failed to prove that fear and terror of the accused pervaded society or that they had gained worldly and material benefit through illegal acts. Holding that the trial court had properly considered the prosecution evidence and that its judgment and order contained no error or illegality, the Court found no proper ground to grant the State leave to appeal and rejected the leave application; consequently, the delay-condonation application was held not required to be decided and was consigned, and the appeal was consigned without being heard.

राज्य सरकार के िवद्वान अपर शासकीय अिधवक्ता प्रथम श्री मो० आिसफ खान को सुना तथा पत्रावली का अवलोकन िकया।

यह अपील राज्य सरकार ने िवशेष न्यायाधीश (िगरोहबन्द अिधिनयम) / अपर सत्र न्यायाधीश, कक्ष संख्या 3, लखीमपुर खीरी द्वारा दािण्डक वाद संख्या 183 सन 2004, जो मुकदमा अपराध संख्या 440 सन 2003 अंतगर्त धारा 386, 364 भा०दं०सं० एवं धारा 2/3 उ०प्र० िगरोहबन्द एवं समाज िवरोधी िक्रया कलाप (िनवारण) अिधिनयम, 1986 से उत्पन्न हुआ, में पािरत िनणर्य तथा आदेश िदनांक 13.06.2025 के िवरुद्ध प्रस्तुत की गयी है, िजसके माध्यम से िवपक्षी संख्या 2 तथा 4 क्रमशः रामजीत एवं चिन्द्रका को उपरोक्त अपराधों से दोषमुक्त कर िदया गया।

अपील प्रस्तुत करने हेतु अनुमित िदये जाने के प्राथर्ना-पत्र पर तकर् सुने गये एवं आलोच्य िनणर्य का पिरशीलन िकया गया।

आलोच्य िनणर्य में अंिकत है िक वादी मुकदमा िशवरतन द्वारा पुिलस को प्राथर्ना-पत्र देकर कहा गया था िक िदनांक 27/28.06.2003 की रात 12 बजे उसकी साली की अिभयुक्तगण ने गोली मारकर हत्या कर दी थी व िशकायतकतार् को गोली मारकर घायल कर िदया था। इस संबंध में िदनांक 28.06.2003 को उसने मुकदमा अपराध संख्या 409 सन 2003 अंतगर्त धारा 452, 307, 302 भा०दं०सं० िलखाया था िजसमें चारों अिभयुक्तगण कारागार में बंद थे। िदनांक 09.07.2003 को िशकायतकतार् का छोटा भाई कारागार में िमलाई के िलए गया था जहाँ उसको बताया गया िक अिभयुक्तगण जेल में कह रहे थे िक िशकायतकतार् उन्हें 50 हजार रुपये दे या जमीन व घर छोड़कर चले जायें। िशकायतकतार् ने यह कहा िक अिभयुक्तगण उसका एक इंजन तथा डनलप उठा ले गये थे व उसे िवश्वास है िक उसके ससुर को अिभयुक्तगण ने गायब िकया।

न्यायालय में िशकायतकतार् अिभयोजन साक्षी संख्या 1 के रूप में परीिक्षत हुआ तथा उसने कहा िक अिभयुक्तगण ने िकसी की संपित्त को हड़पा नहीं है तथा वह मजदूरी करके अपना जीवन यापन करते हैं।

अिभयोजन साक्षी संख्या 2 ने कहा िक उसके भाई की साली को िकसने मारा था उसे इसकी जानकारी नहीं है। अिभयुक्तगण (रामजीत व चिन्द्रका) का गांव व समाज में कोई भय व आतंक नहीं था तथा यह दोनों व्यिक्त मजदूरी करके अपने पिरवार का पालन-पोषण करते हैं। उन्होंने दबंगई व गुंडई के दम पर कोई संपित्त नहीं हिथयाई तथा ये शाितर िकस्म के व्यिक्त नहीं हैं।

उपरोक्त दोनों सािक्षयों के कथनों की समीक्षा करके िवचारण न्यायालय ने यह पाया िक अिभयोजन यह िसद्ध करने में असफल रहा है िक अिभयुक्तगण रामजीत व चिन्द्रका का भय व आतंक समाज में व्याप्त है और उन्होंने अवैध कायर् करके दुिनयावी व भौितक लाभ प्राप्त िकया।

न्यायालय का मत है िक िवचारण न्यायालय ने अिभयोजन साक्ष्य की सम्यक िववेचना करके अिभयुक्तगण को दोषमुक्त िकया है। िवचारण न्यायालय के िनणर्य तथा आदेश में कोई त्रुिट अथवा अवैधािनकता नहीं है। इस कारण से राज्य सरकार को दोषमुिक्त के िनणर्य तथा आदेश िदनांक 13.06.2025 के िवरुद्ध अपील प्रस्तुत करने की अनुमित देने का कोई उिचत आधार नहीं है।

तद्नुसार, अपील प्रस्तुत करने के िलए अनुमित हेतु िदया गया प्राथर्ना-पत्र िनरस्त िकया जाता है।

Order On Delay Condonation

जब न्यायालय ने अपील प् र स्तुत करने की अनुमित का प्राथर्ना-पत्र िनरस्त कर िदया है तो अपील प्रस्तुत करने में हुए िवलंब को क्षमा करने के प्राथर्ना-पत्र के िनस्तारण की कोई आवश्यकता नहीं है।

तद्नुसार, प्राथर्ना-पत्र िनक्षेिपत िकया जाता है।
