The present petition is filed with the following prayer:

"(A) To set-aside the impugned order dated 25.02.2026 passed by Principal Judge, Family Court, Banda in Criminal Misc. Case No.409/XI/2023 (Mohd. Shifat Vs. Km. Adeeba (Minor).

(B) To stay the recovery proceeding in Criminal Misc. Case No. 409/XI/2023 (Mohd. Shifat Vs. Km. Adeeba (Minor)."

At this stage, learned counsel for petitioner submits that he may be permitted to withdraw the present petition with liberty to file stay application in the pending Application U/S 482 Cr.P.C.

Accordingly, the petition is dismissed as withdrawn with aforesaid liberty.

Certified copy, if any, shall be returned to learned counsel for petitioner after keeping a photo copy of the same.
