Animesh Anand), instituted on 16.08.2024 under Section 13(1)(1-a), Hindu Marriage Act, 1955 on the ground of cruelty. The respondent appeared on 11.03.2025 and received a copy of the plaint, but on three dates fixed thereafter neither appeared nor filed the written statement; the Family Court had also not passed an Order 8 Rule 1 CPC order closing the written-statement opportunity. यािचकाकतीर् की िवद्वान अिधवक्ता कु० आयुषी िमश्रा को सुना।

भारतीय संिवधान के अनुच्छेद 227 के अंतगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतीर् ने िवद्वान प्रधान न्यायाधीश पािरवािरक न्यायालय , लखनऊ को वैवािहक िववाद संख्या 3951/202 4 ( लारा दत्ता बनाम अिनमेष आनंद ) अंतगर्त 13 (1) (1- क ), िहदू िववाह अिधिनयम , 1955 का शीघ्र िनस्तारण का िनदेर्श देने का अनुरोध िकया है।

उपरोक्त मूल वाद यािचकाकतीर् ने क् र ूता के आधार पर िववाह िवच्छेद की आज्ञिप्त प्राप्त करने हेतु िदनांक 16.08.2024 को प्रस्तुत िकया था। िदनांक 11.03.2025 को िवपक्षी - प्रितवादी पािरवािरक न्यायालय में उपिस्थत हुआ है एवं वाद - पत्र की प्रित प्राप्त की है। इसके बाद वाद में तीन ितिथयां िनयत हुई िकतु न तो प्रितवादी प्रस्तुत हुआ न ही उसने प्रितवाद - पत्र प्रस्तुत िकया।

पािरवािरक न्यायालय ने आदेश 8 िनयम 1 व्यवहार प्रिक्रया संिहता के प्रावधान के अंतगर्त प्रितवादी द्वारा प्रितवाद - पत्र प्रस्तुत करने का अवसर समाप्त करने का आदेश भी पािरत नहीं िकया है।

धारा 21- ख िहदू िववाह अिधिनयम के प्रावधान िनम्नवत् हैंः -

21 ( ख ). इस अिधिनयम के अधीन अिजयों के िवचारण और िनपटारे से संबंिधत िवशेष उपबन्ध -

(1) इस अिधिनयम के अधीन अजीर् का िवचारण , जहां तक िक न्याय के िहत से संगत रहते हुए उस िवचारण के बारे में साध्य हो , िदन प्रितिदन तब तक िनरन्तर चालू रहेगा जब तक िक वह समाप्त न हो जाए िकन्तु उस दशा में आवश्यक समझे जो लेखबद्ध िकए जाएंगे।

(2) इस अिधिनयम के अधीन रह अजीर् का िवचारण जहां तक संभव हो शीघ्र िकया जाएगा और प्रत्यथीर् पर अजीर् की सूचना की तामील होने की तारीख से छः मास के अन्दर िवचारण समाप्त करने का प्रयास िकया जाएगा।

(3) इस अिधिनयम के अधीन हर अपील की सुनवाई जहां तक संभव हो शीघ्र की

जाएगी और प्रत्यथीर् पर अपील की सूचना की तामील होने की तारीख से तीन मास

के अन्दर सुनवाई समाप्त करने का प्रयास िकया जाएगा।

उपरोक्त पिरिस्थित में यह यािचका इस िनदेर्श के साथ िनस्तािरत की जाती है िक प्रधान न्यायाधीश पािरवािरक न्यायालय , लखनऊ वैवािहक िववाद संख्या 3951/2024 ( लारा दत्ता बनाम अिनमेष आनंद ) अंतगर्त 13 (1) (1- क ), िहदू िववाह अिधिनयम , 1955 का िनस्तारण आदेश 8 िनयम 1 व्यवहार प्रिक्रया संिहता एवं धारा 21- ख िहदू िववाह अिधिनयम के प्रावधानों को दृिष्टगत रखते हुए िबना िकसी पक्ष को अनावश्यक स्थगन िदए हुए िविधनुसार शीघ्रतापूवर्क िनस्तािरत करना सुिनिश्चत करें।
