HIGH COURT OF JUDICATURE AT ALLAHABAD (LUCKNOW BENCH) — Matters Under Article 227 No. 609 of 2026, decided February 25, 2026 (Subhash Vidyarthi, J.). Constitution of India, Article 227 — direction for expeditious disposal of interim injunction application. The petitioner sought a direction to the learned Civil Judge (Junior Division) to decide, in Original Suit No. 1594/2022 (Pramod Kumar Tiwari v. Asraful Hasan), the pending application under Order 39 Rule 1 CPC (paper no. 4(g)) and the additional objection thereto (paper no. 35-g-1). यािचकाकतार् के िवद्वान अिधवक्ता श्री मो० जैद खान को सुना।

भारतीय संिवधान के अनुच्छेद 227 के अंतगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतार् ने िवद्वान िसिवल जज ( अवर खण्ड ), दिक्षणी सुलतानपुर को मूल वाद संख्या 1594/2022 ( प्रमोद कुमार ितवारी बनाम असरफुल हसन ) में लंिबत प्राथर्ना - पत्र अंतगर्त आदेश 39 िनयम 1 तथा कागज संख्या 4 ( ग ) तथा इसके िवरुद्ध अितिरक्त आपित्त कागज संख्या 35- ग -1 के शीघ्र िनस्तारण का िनदेर्श देने का अनुरोध िकया है।

उपरोक्त मूल वाद िवपक्षी संख्या 1 ने यािचकाकतार् तथा िवपक्षी संख्या 2 से 5 के िवरुद्ध स्थाियव व्यादेश के अनुतोष हेतु प्रस्तुत िकया है। वाद प्रस्तुत करने के िदनांक 14.10.2022 को िवचारण न्यायालय ने एकपक्षीय अस्थायी िनषेधाज्ञा आदेश पािरत कर िदया। यािचकाकतार् ने इसके िवरुद्ध आपित्त िदनांक 18.12.2024 को प्रस्तुत कर दी। यािचका के साथ संलग्न वाद के आदेश - पत्र की प्रित से यह प्रतीत होता है िक अनेक ितिथयों को वाद की सुनवाई िबना िकसी कारण के स्थिगत की गई है।

यािचकाकतार् के िवद्वान अिधवक्ता ने इस न्यायालय के रिजस्ट्रार जनरल द्वारा िनगर्त पिरपत्र िदनांक 16.08.2017 का आश्रय िलया , िजसके द्वारा िवचारण न्यायालयों को यह िनदेर्िशत िकया गया है िक वे अस्थायी िनषेधाज्ञा संबंधी प्राथर्ना पत्रों का िनस्तारण अिनवायर् रूप से छः माह की अविध के भीतर सुिनिश्चत करें। पिरपत्र में यह भी स्पष्ट िकया गया है िक उक्त अविध के भीतर िनस्तारण न होने की िस्थित में , उसके कारणों का स्पष्ट एवं पयार्प्त उल्लेख आदेश पत्र में िकया जाना आवश्यक होगा।
