यािचकाकतार् के िवद्वान अिधवक्ता श्री अनुराग श्रीवास्तव तथा राज्य सरकार के िवद्वान स्थायी अिधवक्ता श्री आशुतोष श्रीवास्तव को सुना तथा पत्रावली का अवलोकन िकया।

भारतीय संिवधान के अनुच्छेद 227 के अंतगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतार् ने ऋण वसूली न्यायािधकरण, लखनऊ द्वारा SA No.- 79 सन 2024 (मेससर् आर.के. ट्रेिडग कंपनी और अन्य बनाम इंिडयन बैंक) में पािरत आदेश िदनांक 05.12.2025 एवं 05.01.2026 की वैधता को चुनौती दी है। िकन्तु यािचकाकतार् के िवद्वान अिधवक्ता ने कहा िक यािचका प्रस्तुत करने के उपरान्त यािचकाकतार् बैंक को प्रश्नगत संपित्त का कब्जा प्राप्त हो चुका है तथा उपरोक्त अनुतोष अब सारहीन हो चुका है। यािचका में दूसरा अनुतोष यह मांगा गया है िक ऋण वसूली न्यायािधकरण SA No.- 79 सन 2024 का िनस्तारण शीघ्रतापूवर्क करें।

यािचकाकतार् के िवद्वान अिधवक्ता का कथन है िक ऋण वसूली न्यायािधकरण के समक्ष यािचका वषर् 2024 से लंिबत है। िदनांक 30.01.2026 को अगली ितिथ िदनांक 13.08.2026 की िनयत कर दी गयी है।

सारफेसी एक्ट (िवत्तीय पिरसंपित्तयों के प्रितभूितकरण एवं पुनिनमार्ण एवं सुरक्षा िहत प्रवतर्न अिधिनयम) की धारा 17(5) के प्रािवधान िनम्न प्रकार है- उपधारा (1) के तहत िकए गए िकसी भी आवेदन पर ऋण वसूली न्यायािधकरण द्वारा यथाशीघ्र कारर्वाई की जाएगी और ऐसे आवेदन की तारीख से साठ िदनों के भीतर उसका िनपटारा िकया जाएगा; बशतेर् िक ऋण वसूली न्यायािधकरण समय-समय पर िलिखत रूप में दजर् िकए जाने वाले कारणों से उक्त अविध को बढ़ा सकता है, लेिकन इस प्रकार िक ऋण वसूली न्यायािधकरण के समक्ष आवेदन के लंिबत रहने की कुल अविध उप-धारा (1) के तहत िकए गए ऐसे आवेदन की ितिथ से चार महीने से अिधक नहीं होगी।

उपरोक्त तथ्यों के आलोक में यह यािचका इस िनदेर्श के साथ िनस्तािरत की जाती है िक ऋण वसूली न्यायािधकरण, लखनऊ SA No.- 79 सन 2024 (मेससर् आर.के. ट्रेिडग कंपनी और अन्य बनाम इंिडयन बैंक) का िनस्तारण िबना िकसी पक्ष को अनावश्यक स्थगन देते हुए, शीघ्रतापूवर्क, िविधनुसार, अिधिनयम की धारा 17(5) को प्रािवधानों को दृिष्टगत रखते हुए, करना सुिनिश्चत करेंगे।
