भारतीय संिवधान के अनुच्छेद 227 के अंतगर्त इस यािचका द्वारा यािचकाकतार् ने िवद्वान अपर मुख्य न्याियक मिजस्ट्रेट, कक्ष संख्या 21, सुलतानपुर को परक्राम्य िलखत अिधिनयम, 1881 की धारा 138 के अंतगर्त प्रस्तुत पिरवाद संख्या 559/2024 के शीघ्र िनस्तारण का िनदेर्श देने

का अनुरोध िकया है।

िवद्वान अपर शासकीय अिधवक्ता ने प्रारंिभक आपित्त रखी िक यह अनुतोष भारतीय नागिरक

सुरक्षा संिहता की धारा 529 के अंतगर्त यािचका प्रस्तुत करके मांगा जाना चािहए तथा वैधािनक

उपचार उपलब्ध होने के कारण संवैधािनक प्रावधान में यािचका पोषणीय नहीं है।

ऐसी आपित्त रखे जाने पर यािचकाकतार् के िवद्वान अिधवक्ता ने संगत वैधािनक प्रावधानों के अंतगर्त नवीन यािचका प्रस्तुत करने की अनुमित मांगी।

तदनुसार, यह यािचका पोषणीय न होने के कारण अंगीकरण के स्तर पर ही िनरस्त की जाती है।

यािचकाकतार् को भारतीय नागिरक सुरक्षा संिहता की धारा 529 के अंतगर्त एक नवीन यािचका प्रस्तुत करने की अनुमित रहेगी।

यािचका के साथ प्रस्तुत प्रमािणत प्रितयां, छायाप्रितयां अिभलेख पर रखते हुए, यािचकाकतार्

के िवद्वान अिधवक्ता को वापस कर दी जाए।
