Heard Sri Akhand Pratap Singh, learned counsel for the petitioner and perused the material available on record.

In view of the proposed order being passed, notice to respondents is hereby dispensed with.

By means of the present petition under Article 227 of the Constitution of India, the petitioner has prayed for the following relief:

"i. To issue order or direction commanding Civil Judge, Junior Division, (FTC) Lucknow to decide the Application under order 39 Rule 1 & 2 read with Section 151 of CPC in Regular Suit No. 180/2019 (Anand Pratap Narayna Singh Versus Smt. Juhi Singh and others) pending before the Civil Judge, Junior Division, (FTC) Lucknow, within the stipulated period as prescribed by this Hon'ble Court."

The submission of the learned counsel appearing on behalf of the petitioner is that the petitioner had filed a suit for cancellation of saledeed and permanent injunction in the year 2019. It is further submitted that the petitioner had also filed an application under Order 39 Rule 1 & 2 read with Section 151 of CPC. The said application is pending since the year 2019. already been filed and the same are available on record. It is stated on behalf of the petitioner that due to the pendency of the said application for interim relief, the petitioner is facing undue hardship.

Taking into consideration the submission advanced by the learned counsel for the petitioner, this Court finds it appropriate to direct the learned Civil Judge, Junior Division (FTC) Lucknow to decide the pending Application under order 39 Rule 1 & 2 read with Section 151 of CPC in Regular Suit No. 180/2019 (Anand Pratap Narayna Singh Versus Smt. Juhi Singh and others), expeditiously strictly in accordance with law, after affording opportunity of hearing to the parties concerned, unless there is any legal impediment. It is further directed that no unnecessary adjournments be granted to either of the parties and the adjournment, if prayed for, the same shall be granted only in exceptional circumstances.
