"I. Issue a writ, order or direction in the nature of mandamus commanding and directing the opposite party no. 2 District Magistrate, District Barabanki, to decide the application dated 08.01.2026 moved by the petitioner through registered post, as contained in Annexure No. 2 to this writ petition.

II. Issue a writ order or direction in the nature of mandamus thereby commanding the opposite party no. 1 to 3 to free the Chak Marg the Gata No. 489, Khata No. 2658 area 0.0700 hectare, which is recorded as Chak Marg in the revenue record situated in Village Bhitouli Kalan, Pargana Dewa, Tehsil-Nawabganj, District Barabanki.

III. Issue a writ order or direction in the nature of mandamus thereby commanding the opposite party no. 1 to 3 to free the Chak Marg after removing the illegal encroachment."

submits that he has received instructions from the Sub Divisional Officer, Nawabganj, District Barabanki dated 26.02.2026. The same is taken on record. The relevant portion of the said instructions reads as under:-

कृपया उपयुर्का िवषयक गाठ उच्च न्यायालय इलाहाबाद पीर लखनऊ में धोिजत िरट WRIT PUBLIC INTEREST LITIGATION (WPIL)-185/2026 | हिरओम बनाम , उत्तर प्रदेश राज्य व अन्य में अिभकचन दािखल कराये जाने के िनदेर्श िदये गये है। तत्कम में प्रश्नगत िरट यािचका में विणत तथ्यों की जांचोपरान्त अिभकथन िनम्नवत् है -

ग्राम िभटौलीकला परगना देवा, तहसील नवाबगंज, बाराबंकी िस्थत भूिम गाटा संख्या 489/0.070हे. चकरोड, 6-2/अकृिषक भूिम स्थल, सड़कें, रेलवे, भवन और ऐसी दूसरी भूिमयां जोअकृिषत उपयोगों के काम में लायी जाती हो के रूप में अंिकत है। स्थलीय जाब में बकरोड भूिम के अगल-बगल के कृषकों द्वारा अितकिमत िकया गया था. िजसे राजस्व टीम द्वारा िचन्हांिकत करते खाली करा िदया गया है, वतर्मान चकरोड भूिम गाटा सख्या 489/0.070हे० स्थल पर िरक्त है तथा अितक्रमण मुक्त है। (संलग्नक फोटोग्राफ)।

अस्तु अनुरोध है िक मा० उच्च न्यायालय को उपरोक्त तथ्यों से अवगत कराने का कष्ट करें। संलग्नक-यथोक्त।"

The copy of aforesaid instructions has been provided to the learned counsel for the petitioner, who is satisfied with the action taken by the State authorities.

In view of the aforesaid, there is nothing left to be adjudicated in the matter.

Accordingly, the present petition is disposed of in view of the above quoted statement made by the Sub Divisional Officer, Nawabganj, Barabanki through his aforesaid instructions.
