Heard learned counsel for the petitioner, learned Standing Counsel on behalf of respondents no.1 to 4 and Shri Mohan Singh, learned counsel appearing on behalf of respondent no.5.

Grievance raised in the present petition is with regard to cancellation of patta under the provisions of Uttar Pradesh Bhoodan Yajna Act, 1952 where according to the complaint land which was allotted to the petitioner was not agricultural land and number of trees were standing on the said land which were planted by the complainant.

Initially, the complaint was rejected when the cancellation was proceeded under the provisions of UPZALR Act and it was held that any allotment made under the Bhoodan Yajna Act of 1952 could not be cancelled as per the provisions of the UPZALR Act and accordingly fresh proceedings for cancellation were initiated against the petitioner under section 198 (4) of UPZALR Act cluminating into the impugned order dated 20.6.2018.

Learned counsel for the petitioner submits that some inquiry was conducted and report of the Tehsil was obtained on the basis of which impugned order was passed. It is further submitted that copy of the said inquiry report was never given to the petitioner.

Impugned order is in clear violation of Section 15 (A) (3) of Uttar Pradesh Bhoodan Yajna Act, 1952 where it is provided that order for cancellation can be passed only after giving opportunity of hearing to the allottee.

Learned counsel for the petitioner prays for and is granted three weeks' time for filing counter affidavit. Two weeks' time thereafter is granted to the learned counsel for the respondents for filing rejoinder affidavit.

Till the next date of listing status quo with regard to the disputed property shall be maintained.
