Heard learned counsel for the petitioner, Shri Gyanendra Kumar Srivastava, learned counsel appearing for respondent no.2 as well as learned Standing Counsel for the State-respondent(s) and perused the material available on record.

The present petition has been filed with the following prayer:

"(i) Issue writ order or direction in the nature of Certiorari quashing the impugned order no. 1728/25 dated 03.09.2025 passed by the Opp. party no.2;

(ii). Issue a writ, order or direction in any nature of mandamus directing the opposite party no.2 accept the D.D. no. 117238 dated 01.09.2025 and issue the admit card to the petitioner for 3rd year GNM (Diploma in General Nursing & Midwifery (3 years Course) course examination 2025 schedule pronounces practical fixed on dated 08.09.2025 and written examination held from the 09.09.2025 to 23.09.2025, in the interest of justice;

(iii) Issue a writ, order or direction in any nature of mandamus directing the opp. Party no.2 and 3 permit the petitioner in the GNM (Diploma in General Nursing & Midwifery (3 years Course) in 3rd year Examination which is going to be conducted by the opp. party no.2 and 3, in the interest of justice."

It is argued by counsel for the petitioner that in similar cases, this Court has passed an order on 3rd September, 2025 allowing the writ petition. It is further argued that in terms of the earlier order passed by this Court on 01.09.2025, the petitioner had approached the respondent along with a bank draft, however, the same was rejected mainly on the ground that this Court itself had fixed a timeline in the Judgment passed by this Court in Writ-C

While considering the similar argument, this Court in Writ-C No. 8746 of 2025 vide its judgment dated 03.09.2025, has relegated the matter to be decided afresh.

It is clarified that the demand draft taken by the petitioner shall be accepted by the respondent and to allow the students to appear in the said examination, which is scheduled to be held from 08.09.2025.

It is further clarified that the decision shall be taken positively, if possible today itself all latest by 8:00 pm.

Petition stands disposed of with the aforesaid observations.
