Heard learned counsel for the petitioner and learned counsel for the respondents.

The petitioner by means of the present writ petition has prayed for following relief:

"i issue a writ, order or direction in the nature of mandamus directing the respondents particularly respondent no. 2 to provide 7.5 HP Electricity Connection to the petitioner forthwith in pursuance of the deposited amount Rs. 76,419.00 with receipt No. 3450472306201616001 dated 23.06.2020, so that the petitioner be able to do his agricultural work."

Sri N.K. Tiwari, learned counsel for the respondents, on the basis of instructions, states that the petitioner is not entitled to subsidy and, therefore, is required to deposit a sum of Rs. 1,22,102/- as per the estimate. He submits that the petitioner has already deposited Rs. 76,419/and if the petitioner deposits the balance amount, electricity connection shall be provided to the petitioner forthwith.

In view of the aforesaid submission, learned counsel for the petitioner submits that although the petitioner is entitled to the subsidy, he is ready to deposit the balance amount of Rs. 45,683/- under protest.

The question as to whether the petitioner is entitled to subsidy or not can be very well decided by the competent authority.

In such view of the fact, the writ petition is disposed of permitting the petitioner to deposit the balance amount of Rs. 45,683/- within a period of three weeks from today. On depositing the said amount, the respondent no. 2 shall, without any delay, install the electricity connection of the petitioner within a period of three days from the date of deposit of the balance amount of Rs. 45,683/-.

The petitioner is further directed to submit a detailed representation before the respondent no. 2 ventilating his grievances regarding the entitlement of the petitioner to the subsidy. On submitting the said representation, the respondent no. 2 shall consider and decide the same strictly in accordance with law within a period of one month from the date of submission of the representation, after giving due notice and opportunity of hearing to the petitioner. The deposit of Rs. 45,683/- shall be subject to the decision taken by the respondent no. 2 on the representation of the petitioner.
