Let King George's Medical University ( in short 'KGMU') be impleaded as opposite party no.3, during the course of the day.

Heard Sri Shobhit Singh, learned counsel for the petitioner, Sri Rajesh Kumar Tiwari, learned Additional Chief Standing Counsel, Sri Shubham Tripathi, learned Counsel appearing for KGMU.

The present petition has been filed for the following main relief:-

"i. Issue a writ, order or direction in the nature of mandamus to Opposite Parties / OP No. 2 to constitute the team for medical termination of pregnancy of "Minor X" who is victim of sexual offence and to facilitate the pre-operational and post-operational procedure, medical expenses and medical care including the transportation of victim "Minor X" or the hospitalization, etc.

ii. Issue a writ order or direction in the nature of MANDAMUS commanding the opposite party no. 2 to preserve the tissues and blood samples of the fetus directing the concerned hospital where pregnancy is terminated."

Admitted position is that the victim at present is having pregnancy of

28 weeks 4 days.

Taking into consideration the factual matrix of the present case in the light of the observations made in various pronouncements on the issue including the judgment passed by the Hon'ble Delhi High Court in the case of X v. State (NCT of Delhi) , reported in 2025 SCC OnLine Del 250 as also the judgment passed by the Hon'ble Apex Court in the case of A v. State of Maharashtra, reported in (2024) 6 SCC 327, wherein the Hon'ble Apex Court considered as under:-

" Conclusion

In the facts and circumstances of this case, we issue the following directions:

37.1. Sion Hospital shall bear all the expenses in regard to the hospitalisation of the minor over the past week and in respect of her re-admission to the hospital for delivery as and when she is required to do so; and

¶20

37.2. In the event that the minor and her parents desire to give the child in adoption after the delivery, the State Government shall take all necessary steps in accordance with the applicable provisions of law to facilitate this exercise. This shall not be construed as a direction of this Court binding either the parents or the minor and the State shall abide by the wishes as expressed at the appropriate stage.

In light of the issues which arose before this Court we record our conclusions as follows:

38.1. The MTP Act protects the RMP and the Medical Boards when they form an opinion in good faith as to the termination of pregnancy;

¶23

38.2. The Medical Board, in forming its opinion on the termination of pregnancies must not restrict itself to the criteria under Section 3(2-B) of the MTP Act but must also evaluate the physical and emotional well-being of the pregnant person in terms of the judgment;

38.3. When issuing a clarificatory opinion the Medical Board must provide sound and cogent reasons for any change in opinion and circumstances; and

¶25

38.4. The consent of a pregnant person in decisions of reproductive autonomy and termination of pregnancy is paramount. In case there is a divergence in the opinion of a pregnant person and her guardian, the opinion of the minor or mentally ill pregnant person must be taken into consideration as an important aspect in enabling the court to arrive at a just conclusion."

In case, the Board in the light of the observations made by the Hon'ble Apex Court in the case of A v. State of Maharashtra (Supra) and the Government Order dated 10.08.2022 as quoted above, finds that the pregnancy can be terminated, in that event the exercise shall be carried out forthwith and the fetus shall be preserved for the purposes of investigation, under the immediate intimation to the Investigating Officer concerned, who shall do the needful in the matter.
