Heard Sri Mohd. Mansoor, learned counsel for the petitioners and Sri Badrish Kumar Tripathi, learned Additional Chief Standing Counsel for the State-respondents.

This Court, vide order dated 11.06.2025, passed the following order:-

"1. Heard Sri Mohd. Mansoor, learned counsel for the petitioner and Sri Ravindra Kumar Chaudhary, learned Additional Chief Standing Counsel for the State-respondents.

By means of the present writ petition, the petitioner has challenged the order dated 04.06.2025 passed by the District Magistrate, DistrictAmbedkarnagar, by means of which a direction has been issued to the Sub Divisional Magistrate, Tehsil- Akbarpur, District- Ambedkarnagar to demolish the Madarsa Madinatul Islam within 25 days and submit a report till 30.06.2025.

3. Contention of the learned counsel for the petitioner is that without following the procedure as provided under the U.P. Revenue Code, 2006 or otherwise, the impugned order has been passed even without affording any opportunity of hearing to the petitioner.

4. Learned Additional Chief Standing Counsel appearing on behalf of the State-respondents prays for and is allowed a day's time to seek instructions in the matter.

5. Put up this case on 13.06.2025 in the list of fresh cases."

Precisely, the case of the petitioners is that vide the impugned order dated 04.06.2025, the District Magistrate, Ambedkar Nagar issued direction to the Sub Divisional Magistrate, TehsilAkbarpur, District- Ambedkar Nagar to demolish the building of the petitioner-Institution.

Submission of the learned counsel for the petitioner is that the aforesaid order is per se illegal as the same has been passed without following the due process of law more particularly without affording any opportunity of hearing to the petitioner.

Learned Additional Chief Standing Counsel has placed written instructions dated 12.06.2025 received from the office of the Sub Divisional Magistrate, Tehsil- Akbarpur, DistrictAmbedkar Nagar. The same are taken on record.

Sri Badrish Kumar Tripathi, learned Additional Chief Standing Counsel, on the basis of the aforesaid instructions, submits that a Letter dated 11.06.2025 has already been written by the Sub Divisional Magistrate, Tehsil- Akbarpur, DistrictAmbedkar Nagar to the District Magistrate, Ambedkar Nagar.

The relevant portion of the aforesaid Letter dated 11.06.2025 is being reproduced as under:-

उककबसमबनधममसकदरअवगतकरकनकहहअतभलबखररपररकणकबददरकनपकरकगरकतक सभचरममतहसरलअकबरपपरकबकमकसक 02 परअसतकतमदरसकमदरनतपलइसलकमदकउद शहरदजसझदलर , गकमजसझदलरपरगनकवतहसरलअकबरपपरजनपदअमबबडकरनगरकक खतदनरसनन 1429 सब 1434 फसलरकबखकतकसस० 694 कबगकटकसस 0-2305/0.430 हब० बकगपसचकरतरजहतगरकनकबनकमसबबतदरससकमणररभभतमधरशबणर 1 कदजरहह। उककबआलहकममसभचरकबकमकसक 02 परअसतकतमदरसकमदरनतपलइसलकमदकउद शहरदजसझदलर , ससकमणररभभतमधररममनसथतहहनबकब ककरणइनकब तवरद बबदखलर / धवसतरकरणककककररवकहरनहहककजकसकतरहह।

Learned Additional Chief Standing Counsel further submits that vide order dated 12.06.2025, the District Magistrate, Ambedkar Nagar has modified the impugned order dated 04.06.2025.

The relevant portion of the modified letter/order dated 12.06.2025 is being reproduced as under:-

In view of aforesaid changed circumstances, this Court finds that once the impugned order dated 04.06.2025 has been modified and the aforesaid letter dated 11.06.2025 make it clear that the building of the petitioner-Institution does not situate on the land belonging to the Goan Sabha rather the same is situated on the private land, nothing remains to be adjudicated in the present writ petition.

In view of the statement made by the learned Additional Chief Standing Counsel, on the basis of instructions and the modified order/letter dated 12.06.2025 and the letter dated 11.06.2025 as quoted hereinabove, the writ petition is disposed of .
