This writ petition has been filed with the following prayers :-
"i. Issue Writ order or direction in nature of mandamus commanding and directing the opposite parties to fix the circle rate of petitioner 82 lakh per hectare as has been given to other land similarly situated land holders
ii. Issue Writ order or direction in the nature of mandamus commanding and directing the opposite parties to pay the compensation amounts of petitioner as calculated Rs. 16,11,200/-.
iii. Writ order or direction in nature of mandamus commanding and directing the opposite parties to pay the differences of circle rate after fixation of increased Circle rate."
Learned counsel for the State-respondents has raised a preliminary objection regarding the maintainability of the writ petition on the ground that no mandamus can be issued, as prayed for, in the prayer clause by the petitioner.
Learned counsel for the petitioner at this stage says that in the same village, the Collector has fixed Rs. 85 Lac per hectare as compensation.
Let a Short Counter Affidavit be filed with regard to the averments made in the writ petition within four weeks.
