Learned counsel for the petitioner, after arguing at some length, submits that he may be permitted to withdraw the petition with liberty to file his petition for the appropriate court in terms of the remedy as available in the U.P. Revenue Code 2006.
With the aforesaid liberty, the petition is dismissed . However, apprehension expressed by the petitioner in light of the order which has earlier been passed would come in his way is also misconceived for the reason that since it is admitted that the petitioner was not a party coupled with the fact that the revisional court itself while rejecting the revision of the petitioner has already provided him with liberty, hence this Court does not deem appropriate to observe anything more.
