Heard Shri Rohit Kumar Singh, learned counsel for the petitioner; learned Standing Counsel for State respondent no.1 and Shri Ashish Agarwal, learned counsel for respondent nos.2 and 3.

The instant writ petition is preferred seeking following principal reliefs:-

"i. Issue a writ, order or direction in the nature of certiorari quashing the order dated 08.10.2025 passed by the respondent no.2/UPSIDA Kanpur, rejecting the building plan application/map of the commercial complex (Karan Complex) of the petitioner having Plot No.7, Industrial Sector D-1 (P-2) at Trans Delhi Signature City, Ghaziabad in totally ex-parte proceeding (Annexure No.1 to the writ petition).

ii. Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 and 3 to approve the building plan application/map of the commercial complex (M/s Karan Complex) having Plot No.7, Industrial Sector D-1 (P-2) at Trans Delhi Signature City, Ghaziabad.

iii. Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 and 3 to extend the time limit of completing the commercial complex as the respondent nos.2 and 3 to reject the building plan/map of the petitioner thrice although the petitioner had paid fees all the time."

Learned counsel for the petitioner submits that the land in question was transferred to the petitioner for construction of commercial complex

vide permission letter dated 21.09.2023 issued by Project Officer, Uttar Pradesh State Industrial Development Authority. The possession of the land was also handed over to the petitioner on 19.06.2024. The petitioner paid the required fees and provided NOC for sanction of the map but the application of petitioner for approval of building plan has been rejected on 08.102025 on the ground that the map cannot be possible to sanction other than Dharam Kanta. He submits that the petitioner has invested huge amount for the present commercial complex but as the respondents are not approving the building plan/map, the petitioner is facing financial loss and as such, this Court should come for rescue and reprieve the petitioner.

Put up this matter again as fresh on 08.01.2026 .

Let the Chief Executive Officer, Uttar Pradesh State Industrial Development Authority, Kanpur file his personal affidavit in the instant proceeding on or before the date fixed in the matter.
