Heard Sri Ramashankar Yadav, learned counsel for the petitioner and learned Standing Counsel for the State.

Present petition has been filed by the petitioner, who states that he was implicated in a Case Crime No. 210 of 2017 for offences, inter alia , under Section 354 gha IPC and Section 8 of the POCSO Act, from which case, he has been acquitted by the Court concerned at Fatehpur vide order dated 03.03.2022.

The petitioner has alleged police excess against the respondents by stating that the acquittal notwithstanding, the police personnels are continuously harassing him and his family by making repeated visits to their house and threatening to falsely implicate him. In this regard, the petitioner has also made a complaint to Superintendent of Police, Fatehpur and District Magistrate, Fatehpur giving the aforementioned details against the police personnels. He has also filed along with this petition, photographs, alleged to be of the police men, who are harassing his family, at the door just outside his home. He has also stated that there was one call from respondent no.4, which details he has given along with the petition.

This petition is disposed of with a request to Superintendent of Police, Fatehpur to examine this issue as the petition transcends mere allegations and there is some supportive material annexed along with the petition, which prima facie , may reflect some truth in the allegations levelled by

Therefore, the Superintendent of Police, Fatehpur is requested to examine the issue and warn the respondent nos. 4 and 5, if the Superintendent of Police, Fatehpur is satisfied that they are indulging in actions which are in excess of police powers. This Court is aware that police in the course of policing also carries out surveillance over suspected people or people with dubious reputation, but that must not extend to such extent that infringes upon the fundamental rights of the suspect, also until and unless there are reasonable or firm ground for doing so.
