Heard Sri Sanjay Kumar Pandey, holding brief of Sri Vikas Kumar Singh, learned counsel for the petitioner, learned Standing Counsel for the State respondents and Sri Manoj Nigam, learned counsel for the respondent Bank.

The present petition has been filed by the petitioner challenging the notice dated 18.09.2025, issued by the respondent no.5 and recovery notice dated 29.09.2025, issued by the respondent no.4 under Section 95 of the U.P. Cooperative Societies Act, 1965 read with rules 313 to 354 of the U.P. Cooperative Societies Rules, 1968.

It is contended by the counsel for the petitioner that petitioner had taken loan for agricultural purposes for a sum of Rs.1,50,000/- but he failed to repay the same. Recovery proceedings have been initiated against him and in the notices issued, the Bank has mentioned different principal amount and also wrongly calculated the interest.

Sri Manoj Nigam, learned counsel appearing for the respondent Bank states that for redressal of petitioner's grievance, he has a remedy under Section 70 of the Act of 1965 before the Registrar, Cooperative Societies.

Faced with the aforesaid submission on behalf of the Bank, learned counsel for the petitioner submits that petitioner be permitted to approach the Registrar, Cooperative Societies in respect of his grievance.

In view of the aforesaid facts and circumstances, the present petition is disposed of with liberty to the petitioner to approach the concerned Registrar, Cooperative Societies in respect of his grievance, under Section 70 of the Act of 1965.

It is made clear that this Court has not expressed any opinion on merits of the case.
