Heard learned counsel for the petitioner and learned Standing Counsel for the respondent-State.

The present writ petition has been filed seeking a direction to the respondent no.2 to decide the application made for grant of firearm licence to the petitioner dated 30.11.2024.

It is contended by learned counsel for the petitioner that even after expiry of sufficient period, petitioner's application has not been considered.

Learned Standing Counsel states that in case petitioner's application has not been considered, so far, the same shall be examined by the competent authority in accordance with law.

Rule 13 of the Arms Rules, 2013 framed under the Arms Act, 1959 clearly provides time limit of 60 days for consideration of claim for grant of firearm licence from the date of receipt of police report.

In the aforesaid facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration to petitioner's pending application for grant of firearm licence, by passing appropriate order, in accordance with law, within a period of two months from the date of presentation of certified copy of this order.

It is, however, clarified that this Court has not expressed any opinion on merits of the case and all issues are left open to be considered by the authority competent, at the first instance.
