1 . Supplementary affidavit filed today is taken on record.

2 . Heard learned Counsel for the petitioner and the learned Standing Counsel.

3 . The present petition has been filed with the following prayers:

" i. issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 12/05/2023 passed by the Opposite Party No.2contained as Annexure No.1 to the writ petition.

ii. issue a writ, order or direction in the nature of certiorari quashing the entire alleged election proceedings of the committee of the management and college of "Munshi Ragunandan Prasad Sardar Patel Mahila Mahavidyalaya, Patel Nagar Dusshera Bagh District-Barabanki" held on 24/07/2022 after summoning its original from the opposite parties.

iii. issue a writ, order or direction in the nature of mandamus commanding the Opp. Party No.2 to conduct election of committee of the management and college of "Munshi Ragunandan Prasad Sardar Patel Mahila Mahavidyalaya, Patel Nagar Dusshera Bagh District-Barabanki" under the provisions of Section 25(2) of Societies Registration Act, 1860 within the time frame fixed by the Hon'ble Court.

iv. issue a writ, order or direction in the nature of mandamus

commanding the Opp. Party No.1 to appoint Vice Chancellor, Dr. Ram Manohar Lohia Avadh University, Faizabad or District Magistrate, Barabanki or any other person or authority as this Hon'ble Court may deem fit and proper to appoint Authorized Controller to take over the charge of the management of the society namely, Munshi Raghunandan Prasad Sardar Patel Mahila Mahavidyalaya, Patel Nagar, Dussehra Bagh, District Barabanki and the Post Graduate Degree College run by it forthwith till the constitution of duly elected committee of management of the society and college under Section 25(2) of the Societies Registration Act, 1860 read with the bye-laws of the society."

4 . The supplementary affidavit has been filed bringing on record that three elections of the societies have been held by three different sets of persons. The documents showing the three elections have been filed along with the supplementary affidavit.

5 . The submission of the Counsel for the petitioner is that the petitioner is the founder member of the Society. He further submits that on the basis of the three elections held, a state of chaos is prevailing with regard to the affairs of the Society, as such, a direction should be issued to the Deputy Registrar to take appropriate steps to protect the interest of the Society.

In view of the said submission, the present petition is disposed off permitting the petitioner to move an appropriate application before the Deputy Registrar requesting to take a decision on the three elections as has been placed before him. In case, such an application is filed, the Deputy Registrar shall take an action in accordance with law on the application being filed by the petitioner before him. The Deputy Registrar, if he considers appropriate, should take necessary measures to protect the interest of the society.
