Mr. Kamlesh Kumar Singh, learned advocate appears on behalf of petitioner and submits, his client is parent and senior citizen, almost 80 years of age. Private respondent no. 4 is his daughter-in-law, who is causing him harassment. He sought assistance from respondent no. 3 (the Sub-Divisional Officer). The authority on order dated 23rd September, 2025 relegated his client to approach the competent Court. Hence his client is before this Court seeking direction upon the administration to come to his assistance. To that end, the order dated 23rd September, 2025 be quashed directing said respondent to pass fresh order.

Mr. Santosh Kumar Shukla, learned advocate, Additional Chief Standing Counsel appears on behalf of State.

Relying upon petitioner's assertion that he is a parent and senior citizen, we think fit to direct respondent no. 2 (the District Magistrate) to look into grievance of petitioner. This is because he is entitled to relief under Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and Uttar Pradesh Maintenance and Welfare of Parents and Senior Citizens Rules, 2014 casts duty upon administration. We are not inclined to direct issuance of notice on private respondent no. 4 but in discharging duty, said respondent might notice her.

Petitioner will communicate certified copy of this order along with his grievance on a fresh representation made to respondent no. 2 (the District Magistrate). Said respondent upon inquiry, to take such action as may be
