Heard learned counsel for the petitioner and Sri Akhileshwar Singh, learned Additional Chief Standing Counsel for the State respondents.

The instant writ petition has been preferred with the following relief :

"(i) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to consider the case of the petitioner and grant compensation in connection with the part of the land of House no.0051A, Mauja - Kalepur, Tappa & Pargana - Haveli, Tehsil - Sadar, District - Gorakhpur acquired by the state for the purpose of widening of road to four lane with interest."

Considering the facts and circumstances of the case, without expressing any opinion on merits of the issue involved, with the consent of parties herein, the writ petition stands disposed of with an observation that in case, the petitioner moves a fresh application ventilating his grievances before the authority concerned within ten days from today, the same shall be considered and decided in accordance with law expeditiously, preferably within two months, thereafter, in accordance with law.
