Heard learned counsel for the petitioner and learned Standing Counsel on behalf of respondents no.1 to 4.

In view of the order proposed to be passed herein, no useful purpose would be served by putting the respondent no.5 to notice and keeping this petition pending before this Court. However, in case the respondent no.5 feels aggrieved by the order their right to seek modification/variation of the order is being kept reserved.

The only prayer made by counsel for the petitioner is to direct the respondent no.2 namely State Level Caste Scrutiny Committee, under the Chairmanship of Principal Secretary, Social Welfare, Bapubhawan, Secretariat, Lucknow to decide the statutory appeal preferred by the respondent no.5 namely Mahendra Kumar Gupta before the respondent no.2, which is pending consideration since 19.08.2021.

It is stated by learned Standing Counsel that respondent no.2 will decide the aforesaid appeal expeditiously.

Heard learned counsel for the parties.

With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.

From perusal of the record it transpires that on the said appeal hearing was taken place on various occasions but till date no final decision has been taken in the matter.

In this view of the matter and also in the interest of justice, the petition is disposed of with the direction to respondent no.2 to decide the aforesaid appeal most expeditiously and preferably within a period of six weeks from the date of receipt of certified copy of this order.
