Heard learned counsel for the petitioner and learned counsel for the respondents.

The grievance of the petitioners is that their father was issued a Scheduled Caste certificate of the ‘Dhangarh’ category. The petitioners, being similarly situated, are also entitled to the issuance of caste certificates in the same category. However, respondent no. 4 is not issuing the caste certificates to the petitioners. Aggrieved by the said inaction, the petitioners have approached the District Level Caste Scrutiny Committee (respondent no. 2) by filing an appeal, a copy of which is annexed at page 18 of the writ petition. However, the said appeal has not yet been considered or decided by the Committee.

Learned Standing Counsel would contend that no useful purpose would be served in keeping the writ petition pending and appropriate direction be issued to respondent no.2 to consider the grievance of the petitioners.

In such view of the fact, the writ petition is disposed off permitting the petitioners to submit a detailed representation enclosing therewith the copy of application appearing on page 18 of memo of writ petition within a period of one month before respondent no.2/ District Level Caste Scrutiny Committee, through its Chairman, District Magistrate, Ghaziabad.
