The present writ petition has been filed with the following main reliefs:

"(a) Issue a writ, order or direction in the nature of certiorari to quash the Resolution or Discrepancies in Main Select List of ClassVI (JNVST-2025). Issue by Deputy Commissioner through it's letter no. F.5-2(JNVST)/2025-NVS(Laksh) dated 10.06.2025.

(b) Issue a writ, order or direction in the nature of mandamus directing to the respondents to admit the petitioner at Jawahar Navodaya Vidyalaya, Sujanpur, District- Aligarh in Class VIth and permit him to complete his course as a regular student., otherwise applicant shall suffer irreparable loss and injury."

Shri Puneet Srivastava, Advocate appearing on behalf of petitioner has brought attention of the court to the notification dated 26.03.1962 by way of which, as per Government Order dated 12.05.1961, 19 tribes were denotified on the basis that said communities are already included in the list of Scheduled Castes. The petitioner belongs to one of such community i.e. 'Aheriya' mentioned at Serial No. 14 in the Notification dated 26.03.1962. He has further attracted attention to the caste certificate dated 20.11.2023 issued in the name of the petitioner wherein mentioning his caste as 'Aheriya', a note has been appended that the said certificate shall not entitle the petitioner for appointment in denotified tribe; but however the same shall make him eligible for other benefits under the State Government.

Learned Standing Counsel could not dispute that the said note in the

caste certificate dated 20.11.2023 creates an ambiguity; but however, the conjoint reading of the notification dated 26.03.1962 and the note appended in the caste certificate dated 20.11.2023, prima facie , appears to mean that the holder of the certificate shall not be entitled for benefit in the Scheduled Tribe category; but however the benefit shall accrue to him in the Scheduled Caste category.

I find that the petitioner had applied in the Scheduled Tribe category and accordingly he was denied the benefits of reservation in the scheduled caste quota and accordingly there cannot be any infirmity in the impugned order dated 10.06.2025.

Confronted with the aforesaid position, the learned counsel for the petitioner fairly submits that the inadvertent mistake of the petitioner has given rise to the aforesaid situation.

In view of the aforesaid, I find that there is no illegality in the impugned order dated 10.06.2025; but however, it is provided that in any future application, if the petitioner applies as a scheduled caste candidate, he shall be given the benefit of reservation on the basis of the caste certificate issued to him on 20.11.2023, if there is no other legal impediment.

With the aforesaid observations, the present writ petition is disposed of .
