Heard Sri Karunanidhi Yadav, learned counsel for the petitioner, Ms. Vatsala Singh, learned counsel for the National Highways Authority of India and Sri Ambrish Rai, learned counsel for the Union of India.

Learned counsel for the petitioner submits that though the award was declared much earlier but the amount due has been paid subsequently, therefore, the petitioner is entitled for interest in terms of Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, whereas, learned counsel for the National Highways Authority of India says that the amount could not be paid on account of some dispute, which was resolved amicably by way of compromise only in 2024, therefore, interest is not liable to be paid.

The petitioner claiming interest on the alleged delayed payment of amount determined under Section 3G(1) of the National Highways Act, 1956 has moved an application before the competent authority. Let the application be considered and decided by a reasoned order, if there is no other legal impediment within two months, if there is any legal impediment, the same shall be informed to the petitioner.

The Writ Petition stands disposed of.
